1. Who We Are

Banger ("we", "us", "our") is an AI-powered writing tool operated by Banger, available at https://getbanger.tech. We help builders, indie hackers, and creators turn daily notes into polished posts for X (Twitter).

2. About Banger

Banger is a SaaS (Software as a Service) product that provides:

• AI-powered generation of X (Twitter) posts from your raw notes, ideas, and context.
• Git repository integration to auto-trigger post drafts from your commits.
• Engagement tracking and performance analytics for your X posts.
• Feedback loop and narrative memory to improve content over time.
• Cohort benchmarking and trend intelligence to optimize your posting strategy.

Banger is delivered entirely as a web-based service accessible at https://getbanger.tech. No physical product is shipped.

3. Eligibility

By using Banger you confirm that:

• You are at least 18 years old.
• You have the legal capacity to enter into a binding agreement.
• You are not located in a country subject to applicable trade sanctions or embargoes.

4. Accounts

You must create an account to use Banger. You are responsible for keeping your login credentials secure. You must notify us immediately at info@getbanger.tech if you suspect unauthorized access to your account. We are not liable for any loss caused by unauthorized use of your account.

5. Subscriptions, Pricing & Payments

Banger offers the following plans:

• Free Plan: Limited to 3 AI generations per day. No payment required. Includes basic post generation and manual posting.
• Pro Plan: Unlimited AI generations per day. Includes all advanced features — Git integration, engagement tracking, narrative memory, performance-aware style adaptation, cohort benchmarking, and trend intelligence. Billed monthly on a recurring basis.

Current pricing is listed on our Pricing page. All prices are in USD.

Payments are processed by Paddle, our Merchant of Record. Paddle handles all billing, taxes, and payment processing on our behalf. By subscribing you authorize Paddle to charge your chosen payment method on a recurring basis until you cancel. Paddle's terms apply to your purchase at paddle.com/legal/buyer-terms .

We reserve the right to change pricing at any time with reasonable notice to active subscribers.

6. Refund Policy

Due to the digital nature of Banger, all sales are generally final. However, if you experience a technical issue that prevents you from accessing or using the service, contact us within 14 days of your charge at info@getbanger.tech and we will review your case in accordance with Paddle's minimum 14-day refund window.

Refund requests are handled through Paddle, our payment processor. Approved refunds will be credited back to your original payment method. Processing times may vary.

7. Cancellation

You may cancel your Pro subscription at any time through your account settings or by contacting support at info@getbanger.tech. Cancellation takes effect at the end of your current billing period. You will retain Pro access until that date. We do not offer prorated refunds for partial billing periods.

8. Acceptable Use

You agree NOT to use Banger to:

• Generate content that is hateful, abusive, discriminatory, or harassing.
• Produce spam, misinformation, or content that violates X's Terms of Service.
• Attempt to reverse-engineer, scrape, or copy the service's core AI logic.
• Use the service for any unlawful purpose.
• Resell or redistribute generated content as a competing AI writing service.
• Circumvent usage limits or access controls.

We reserve the right to suspend or terminate your account without notice for violations of this section. Our Acceptable Use Policy is aligned with Paddle's Acceptable Use Policy .

9. AI-Generated Content

Banger uses AI to assist in drafting posts. You acknowledge that:

• AI-generated content may not always be accurate, complete, or suitable.
• You are solely responsible for reviewing, editing, and publishing any content generated by Banger.
• We do not claim ownership of content you create using Banger. You own your output.
• By submitting your context inputs (notes, mood, angle), you grant us a limited license to process that data solely to provide the service.

10. X (Twitter) Integration

Banger optionally connects to your X account via OAuth 2.0 to enable tweet analytics and posting workflows. By connecting your X account you authorize Banger to:

• Read your public tweet data and engagement metrics.
• Post to X on your behalf only when you explicitly trigger a post action.

We do not store your X credentials. You can disconnect your X account at any time from your dashboard. Your use of X through Banger is also subject to X's Terms of Service.

11. Privacy

Your privacy matters. Our full Privacy Policy is available at getbanger.tech/privacy. Key practices include:

• Data We Collect: Email address, account activity, usage data, and context inputs (notes, mood, angle) you provide.
• How We Use It: Solely to provide and improve the Banger service, process payments, and communicate with you.
• Data Sharing: We do not sell your personal data. We share data with trusted third-party providers (e.g., Paddle for payments, AI infrastructure) strictly to operate the service.
• Data Retention: Retained while your account is active. Request deletion at info@getbanger.tech.
• Cookies: Used to maintain sessions and analyze usage.
• Security: We implement reasonable technical and organizational measures to protect your data.
• Your Rights: Depending on your jurisdiction, you may have the right to access, correct, or delete your personal data.

12. Intellectual Property

All trademarks, logos, product names, and the underlying software of Banger are owned by us or our licensors. Nothing in these Terms grants you any right to use our intellectual property without our prior written consent.

13. Availability & Modifications

We strive for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue any part of Banger at any time. We will provide reasonable notice for material changes that affect paid subscribers.

14. Disclaimer of Warranties

Banger is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

15. Limitation of Liability

To the maximum extent permitted by law, Banger and its owners shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the service, including but not limited to lost revenue, data loss, or reputational harm. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

16. Paddle as Merchant of Record

Banger uses Paddle as our Merchant of Record for all transactions. This means:

• Paddle is the seller of record for all purchases made through Banger.
• Paddle handles payment processing, tax collection, and compliance on our behalf.
• Your payment receipt will show Paddle as the charge descriptor.
• For billing disputes or payment issues, you may contact Paddle directly at paddle.com or us at info@getbanger.tech.

17. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation first. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.

18. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will notify active users by email or via an in-app notice at least 14 days in advance. Continued use of Banger after updates constitutes acceptance of the revised Terms.
